These Terms of Use ("Terms") govern your access to and use of MomMem, a private family vault for capturing and preserving your child's memories (the "Service"), operated by [Legal entity — TO BE DEFINED] ("MomMem", "we", "us"). By using the Service you agree to these Terms.
1. Acceptance of the terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use MomMem
You must be of legal age in your jurisdiction (at least 18 years old) to create an account. The Service is intended for parents and legal guardians who choose to record memories about a child in their care. You are responsible for ensuring you have the right to capture and store any content about the children and family members you add.
3. Description of the service
MomMem lets you capture moments — a photo and a short voice note — which our software transcribes, organizes, and stores so you can revisit and share them within your family. Features may evolve over time, and we may add, change, or remove functionality at our discretion.
4. Accounts and security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at legal@mommem.com if you suspect unauthorized access. We are not liable for any loss arising from your failure to keep your credentials secure.
5. Your content and a limited license to operate
You retain all rights to the photos, audio, text, and other materials you submit ("Your Content"). You grant MomMem a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transcribe, and display Your Content solely to provide and improve the Service for you and the family members you authorize. We do not sell Your Content and do not use it for advertising.
6. Acceptable use
You agree not to use the Service to: (a) upload content you do not have the right to share; (b) violate any applicable law or the privacy of others; (c) attempt to gain unauthorized access to the Service or its systems; (d) interfere with or disrupt the Service; or (e) use the Service to harm a child or any other person.
7. Subscriptions, trial, and payments
Some features may require a paid subscription. Pricing, billing cycles, and trial terms will be presented at the point of purchase. Unless stated otherwise, subscriptions renew automatically until cancelled. Taxes may apply depending on your location. Specific prices and plans are not part of these Terms.
8. Intellectual property
The Service — including its software, design, trademarks, and branding — is owned by MomMem and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, the provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will remain in effect.
10. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by applicable law, MomMem will not be liable for indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the Service.
11. Governing law and venue
